1. GENERAL
The website kleliasa.com (hereinafter KLELIA) is operated under the management of the commercial company "KLELIA S.A. - TRADE AND TOURIST BUSINESSES", which is located
in Kos, 2 MEROPIDOS str P.O. Box 85300, (hereinafter the "Company"). Access and use of KLELIA, the services and products available through it (hereinafter "Services")
are subject to the following terms and conditions (hereinafter "Terms of Use"). The use of the Services provided requires the agreement to all the KLELIA Terms of Use,
as applicable from time to time. For this reason, it is recommended that users check this page from time to time to be informed of any modifications to the Terms of
Use. The use of KLELIA by the user after being informed of the current terms of use implies acceptance of the terms of use. In case of disagreement with the terms of
use, you are requested not to use KLELIA.
Access to KLELIA is permitted throughout its operation, although the Company reserves the right to withdraw or discontinue the provision of services without prior
notice at any time. The Company shall not be liable in the event of inability to access all or part of the services for any reason whatsoever.
The Company shall make every effort to ensure that the content of KLELIA contains complete, accurate, clear, valid, informative, timely, true, and non-misleading
information. In any case, however, no liability, commitment or guarantee of any kind on the part of the Company in relation to the security and content of KLELIA
arises. Users of KLELIA accept the possibility that the Company may not be able to control all its content and services. Under no circumstances does the information
provided on KLELIA replace the information provided to any interested party through direct contact with the Company's staff.
The use of KLELIA by each user is at his/her sole risk and its content does not constitute and cannot in any way be interpreted as providing advice, direct or indirect
encouragement to users to take any action or action. The evaluation of the content is the responsibility of each user who assumes responsibility for the use of any part
of the content.
It is pointed out to users that KLELIA contains "hyperlinks or banners" to other websites, which are not managed by the Company and the Company has no control over
them, the services provided by them, and the privacy policy maintained on their behalf. The use of these links is subject exclusively to their own terms of use, which
users must be informed of. KLELIA shall not be liable in any way for any loss or damage that users may suffer because of their use. The connection to the
above-mentioned links is at the user's individual risk.
KLELIA users who are minors are not allowed to access KLELIA services that may be considered inappropriate for minors, and which cannot be controlled by KLELIA. If,
however, underage users voluntarily visit pages with material that is inappropriate/offensive/obscene and which cannot be continuously monitored, the Company shall not
be liable.
Users are solely responsible for the possession and maintenance of telephone connections, computers, and general equipment necessary for accessing and using KLELIA's
services.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS - TRADE MARKS
All the content of KLELIA, (including all trademarks, distinctive signs, patents, names, texts, images, graphics, drawings, photographs, programs, information material
in any form, data, software) (hereinafter referred to as content) are the intellectual property of the Company and/or third companies, which have granted the Company
the right to republish, use and post part or all their intellectual property. The Company and/or third parties retain all intellectual property rights in respect of the
content, the republication, copying, uploading, posting, printing or any other use of which is prohibited and is governed by the applicable Greek, Community, and
international legislation on intellectual property (Law 2121/1993 as amended and in force today, the Berne Convention (ratified by Law 100/1975) and the relevant
provisions on the protection of intellectual property on the Internet.
The other products or services mentioned on the KLELIA web pages and bearing the trademarks of the respective organizations, companies, partner organizations,
associations, or publications, constitute their own intellectual and industrial property and consequently these organizations are responsible for the relevant
liability. KLELIA may from time to time publish information that is the personal work and property of its authors. The texts reflect in any case personal opinions and
are according to the law "products of the intellect" protected by the legal provisions on intellectual property and by Law 2121/1993 and by the relevant rules of ethics
of the Internet.
The content of KLELIA does not constitute and in no case should be construed as a grant of express or implied license or right to use any Trademark appearing therein
without the written permission of the Company or third parties that may own the Trademarks appearing therein.
3. RESPONSIBILITY OF THE COMPANY
Given the internationalized nature of the Internet and its volume, any direct, consequential, incidental, indirect or consequential damages resulting from the access of
any user to KLELIA or its use, including the case of negligence, shall not give rise to the liability of the Company, or its executives, or its directors, or its
employees, or its associates or any of its representatives. Users are advised to use software to protect themselves against computer viruses and other types of
malwares.
The Company shall not be liable for damages and expenses incurred in connection with the use of KLELIA, or the inability to use it, by any person, or in connection with
any failure to perform, error, omission, interruption, defect, delay in operation or transmission, or system line failure. In the event that damage, or damage, or
infection by electronic viruses is caused to the computer or other electronic medium used by a user to access/visit/use or download any material, data, text, images,
video, or audio of its contents, the Company shall have no liability whatsoever.
The services available through KLELIA are provided to users "as is". The Company does not guarantee that the content of KLELIA and the quality of the services provided
will meet the requirements and expectations of the users. The Company shall not be liable for any legal, civil, or criminal claims related to the operation or use of
KLELIA, nor for any damage, of any kind, caused either by visitors to KLELIA or by third parties.
4. ELECTRONIC MAIL
By using the KLELIA e-mail service, the user accepts the control by the Company of the origin of his/her message and the use of it as and when deemed necessary by the Company for the service of the visitor/user. To avoid risks of computer viruses the Company may not open and delete any file sent to it by message, especially when its source of origin is not identified.
5. APPLICABLE LAW AND OTHER TERMS AND CONDITIONS
These terms and conditions and any modification thereof shall be governed and interpreted in accordance with Greek law. If any provision is found to be invalid or void, it shall automatically cease to apply, without in any way affecting the validity of the other terms and conditions. The present constitutes the entire agreement between the administrator of KLELIA and the user of its pages and services. No modification of these terms will be considered and will not form part of this agreement unless it has been expressed in writing and incorporated herein. It is hereby expressly agreed that any disputes that may arise from the application of these terms and the general use of KLELIA by the user, are governed by Greek law and if not resolved out of court, are subject to the jurisdiction of the Courts of the Company's headquarters.
